If You Have Applied for a Contractor's License

If you have applied for a contractor’s license in the state of North Dakota and have questions regarding coverage requirements from WSI, please refer to the following:

If you neither employ nor anticipate employing anyone within the state of North Dakota, you are not required to complete an application for workers’ compensation insurance. However, in order to obtain a letter of good standing to provide to the Secretary of State, you must complete either an Independent Contractor's Affidavit of Non-Employment for North Dakota Employer form or an Independent Contractor's Affidavit of Non-Employment for Out-of-State Employer form. The affidavit must be either faxed (701-328-3750) or mailed to WSI. Once the completed form is received by WSI, we will notify the Secretary of State’s office.

Your signature on the affidavit acknowledges that you do not have, nor do you intend to have, employees during the upcoming year. Your signature also indicates that you will secure proper coverage in the event you hire and that you have read and understand the WSI Fraud Warning.

If you are a North Dakota-based business and plan to have employees or if you are an out-of-state employer and plan to have employees working in North Dakota, please refer to our Who Needs Coverage section.
